WHAT EVERY IN-HOUSE COUNSEL SHOULD KNOW ABOUT INSURANCE COVERAGE

Most in-house counsel know some details about the types of insurance their companies or clients buy – with the focus typically on types of coverage, policy limits and cost. When significant claims occur, however, the focus is on the actual policy provisions that often spell the difference between coverage and no coverage. When claim payments are on the line, it is critical to understand the coverage provided under the insurance contract, to have the persistence required to get a claim processed and paid in full; and to be prepared for attempts by the insurance company to wear the policyholder down in the hopes of forcing it to accept either half-a-loaf or no bread at all.
This session will walk in-house counsel through the potential minefields of insurance claims, detailing key issues of policy language and effective claims handling techniques, including:
1. Loss Valuation
2. Short-circuiting insurance company delays
3. Insisting on partial payment when the loss amount is in dispute
