While cybersecurity and data privacy are in the news daily, they are also knocking at the front door of your businesses. Or, they are lurking on the front door step. This interactive discussion, led by a panel of attorneys and technologists, will focus on practical considerations where law meets technology, and where that intersection implicates business strategy, roadblocks, and hurdles. With the passage of GDPR behind us and the California Consumer Privacy Act on the books (for now), the regulatory environment we have to confront on a daily basis related to privacy and cybersecurity matters is becoming increasingly complex. This complexity is furthered by the constant evolution of cyber threats and criminality. The discussion will include:
- Strategic and tactical considerations for building defensible cyber and privacy programs;
- What questions should lawyers ask the technology team, and vice versa?
- Contracting 101 to 401;
- M&A and corporate transaction considerations and diligence needs; and
- The future state of regulations (including from Washington) and is there anything you should do today.
The second hour of the discussion will turn from proactive efforts to reactive investigatory considerations. What do you do if you are compromised, and how do you prepare for that risk today? Much of the security risk we see in today’s courts and regulatory enforcement matters flows directly from victim companies.
